TERMS OF SERVICE
by commissioning me, you agree to the following:
- You will provide as much info as necessary regarding intended project usage and agree to discuss additional uses or changes with me, the artist, after the project starts.

- My work is for personal or private use only, meaning I do not allow my art to be used for unauthorized commercial purposes or income unless commercial usage is specifically agreed upon ordering.
​
- As the artist I still mantain any and all rights to my works; this includes publishing the work on my socials, adding it as a part of my portfolio, including the work in artbooks and editorial projects, unless otherwise agreed with the client. I may monetize the commission in any which way I deem fit.
​
- Neither commissioner nor anyone else is allowed to edit, trace, copy, heavily reference from or imitate the drawing in any way or use it as assets to your liking, including the use of the artwork as a "base" or removing the watermark from the finished product.
You're not allowed to claim my art as your own, even in the case of a paid commission.
Credits to me (paulluxh; the artist) or a link going back to one of my socials must be explicitly given anytime the art is showcased.

- No one is allowed to mint my artwork as a NFT (Non Fungible Token); I'm not interested in partaking in cryptocurrencies and NFTs. My art, whether commissioned, pre-existing or merchandise work, cannot be minted into an NFT by commissioner nor anyone else.

- No one is allowed to upload my art, even commissioned one, in an AI databank and create AI art with it!
​
- I don't make money out of already existing Characters, but out of the art itself only.
Ordering

I reserve the right to refuse any project.

I require a full description, if possible, with references, before approving the project.

Payment
​

All payments must be made through invoices provided by me.

Totaling above 350€, payments may be split, with 50% due up front and 50% due upon sketch approval or first work in progress.

Refunds
​

Once work has begun on the project, I cannot offer a refund under normal circumstances.

If a project cannot be completed due to incapacitation of the artist, the client will be offered a refund and project deliverables based on current project completion and scope on a case-by-case basis.

The client agrees not to file a chargeback without first contacting me.

Complete projects are non-refundable.

Should a chargeback be filed, the commissioner will lose all rights to the commission.
You will be publicly exposed as a warning to other artists. I have the right to dispute the claim to get the money back.

Active Project
​

I reserve the right to stream the progress and to post on social media. The client agrees to specify in their application and ticket if they wish for any materials or work to be hidden.

In case of a delay, I will contact the client to discuss the new scope and schedule.

I will directly upload updates and Work In Progresses at set intervals throughout the project on my Trello.

I can provide additional WIPs by client request on a case-by-case basis when time is available.

If the client fails to respond to feedback/revision requests within 5 days, I reserve the right to continue with the project.

Continuous non-communication of two weeks will result in the project to be considered finished in its current state and will be sent to the client.

Communication

I am not in charge of sending WIPs unless asked for or I feel the need to.

Rude/disrespectful/abusive commissioners will have their commission immediately cancelled with a refund based on how much of the artwork was completed.

If you would like to see a WIP of your commission, please don't hesitate to ask.

There is no limit per order for extra WIPs. But please consider that it will take me extra time to pause work and wait for your feedback!

The sketch phase is your chance to tell me what you want changed: expressions, details, pose, etc. Please don't be shy if something really doesn't sit well with you. I do my best to capture the character's personality based on the information I got but sometimes I do mistakes, especially if it wasn't clear from the order.

My Skebs are excluded from the Communication T.o.S above: For the Skebs there will be no communication throughout the process! I will contact you in the beginning after accepting your request for the payment and once I'm done with your Skeb.

Project Delivery and Revision

Upon final project delivery, I will keep the project open for a week for final revisions. The client should continue to make revision requests through DMs.

Once the artwork is finished, I can do small changes such as color adjustments and/or adding tiny details I may have forgotten.

I will only make changes to the final piece if it was an error on my part (i.e. I missed a detail that you had provided in the order).

Revision requests made after this period will be considered an “upgrade” project and will be processed and scheduled as such.

The responsibility is on you to ensure your order contains the details you want me to follow. I will not redraw commissions unless payment is sent for a second order.

If your reference was unclear to start with, then you are not allowed to make minor changes without a fee. Make sure to be clear in your order what you aim for.

My Skebs are excluded from the Project Delivery and Revision T.o.S above: For the Skebs there will be no revisions.

Usage Rights and Credits

I reserve the right to post completed projects to my website and social media accounts.

The client agrees not to use project deliverables to create any derivative works, repurposed assets, or for any commercial purposes outside of the initial intended use.

The client may contact me to discuss any additional uses after a project is completed.

The client must appropriately credit me, the artist, on all social media and streaming platforms where project deliverables are used. I will provide preferred credits upon project completion.

It is basic knowledge in the art community that you, the client, or an artist you commissioned, have not the right to copy my artstyle that comes with my commissions. You only buy my service of a character design or artwork and not the artstyle itself and reserve the right to call you out on that.

If a client is malicious, the artist may retract the rights to a commission (e.g. racism, sexism, slander)

Terms of Service Changes
​

I may choose to revise these terms from time to time at any point.
-
These changes are retroactive with completed projects and past clients in regard to usage rights and credits, and clients will be contacted if such updates are made.

If changes are made affecting the project process, I will only notify clients with active projects.
-
By continuing to use my art and other project deliverables and services, the client agrees to be bound by the revised Terms.
